During the process, administrators received a contingent claim from Magi Enterprises, trading as Kookai.
The claims made against Bardot related to an infringement of a registered design and a copyright infringement of a fabric print.
Kookai is fiercly protective of its IP, having undertaken Federal Court proceedings against competitors which breach protected designs.
In a case with fast fashion vendor Luvalot, undertakings to the court were obtained together with orders for payment of $127,000 as damages as well as costs orders.
At the time of Bardot's administration, no formal adjudication had been made on the contingent claim.
