The former operators of four Melbourne shoe stores are being hauled into court after they "failed to fully rectify" their underpayment of four workers.
The Fair Work Ombudsman claims Henna Group underpaid the employees at total of $16,036 while they were employed at Scarpe Shoe stores in Melbourne's Docklands, Fountain Gate, Chadstone and Hallam suburbs.
In addition to pursuing the company in court, the Fair Work Ombudsman is also prosecuting the company's director Bulbula Amin and manager Sahil Rasul. Amin and Rasul face maximum penalties of $6600 for each workplace law breach, and Henna Group a maximum fine of $33,000 per breach.
The Fair Work Ombudsman alleges the underpayment of the four workers arose when Henna Group paid employees a flat rate rather than variances for overtime, weekends and public holidays.
It is also alleged the employees did not always get meal breaks, pay slips or receive their wages on a regular basis, and missed out on pay for some hours worked, annual leave entitlements and carer's leave.
Fair Work Ombudsman executive director Michael Campbell said the organisation was pursuing the Henna Group because of the “significant” amount of money owed and the company's failure to fully rectify the matter.
